Note from Richard Dolan. I just received a phone call from Richard Sauder, who has informed me that he stood trial on July 23, and was released from custoday. The judge did find him guilty for trespassing on a federal facility, but sentenced him to time served. So, after three months of custody, Richard is free. He asked me to thank everyone who supported him while he was incarcerated. I am sure he will issue his own statement sometime soon.

A Personal Statement from Richard Sauder
dated 14 July 2010

Note from Richard Dolan, July 22, 2010. I received a handwritten letter from Richard Sauder two days ago and have transcribed it, at his request, for general distribution. Since his arrest and incarceration on April 15, 2010, he has had no access to computers, Internet, or even ordinary phone calls, so his ability to communicate with the outside world is restricted to hand-written correspondence that must be examined by federal authorities. By the standards of Year 2010, this is painfully slow, but it is all he has.

Dr. Sauder's trial date, long delayed, is set for tomorrow, July 23, 2010. Acquittal is very rare in cases of trespass on U.S. military property. We expect him to be sentenced, although for how long we do not know. I will report what I learn as soon as I learn the results.


A Serious Message from the Heart of America

I come in peace as a messenger to North Dakota and the world, here in the dog days of summer 2010.

That is why, on 15 April 2010, I went over the fence and staged a peaceful demonstration on U.S. Air Force nuclear missile silo H-8, at the intersection of 33rd St. And 76th Ave., near Parshall, North Dakota. For this manifestation of creative nonviolence, I was arrested and jailed. For three months I have been incarcerated in the Heart of America Correctional and Treatment Center, located in Rugby, North Dakota, at the precise geographical center of the North American continent.

I traveled to North Dakota from Texas, whose state symbol is a five pointed star. Because my purpose was both serious and prescient, I accordingly placed a five-armed starfish shell on the missile silo. I also placed five conch shells on the silo access hatch, to symbolize the vital importance of the sea. Silo H-8 is located in the midst of North Dakota’s booming oil field. When I straightened up, I saw men hard at work drilling for oil with a large derrick erected in a field just to the south of silo H-8.

Five days later, BP’s Deepwater Horizon Oilwell exploded in the Gulf of Mexico, and the consequences of that catastrophe will be unfolding for a long time to come, with dire impacts on the Gulf of Mexico, the Southeast USA, and much more besides. The entire situation is very serious.

Both BP and the USA government have knowingly lied about the gravity of the situation. This is no accident. The USA is ruling system is now a criminally corrupt “corporate-government,” governed of, by and for the Fortune 500 companies and Wall Street. The USA government is not now in any meaningful degree truly a “participatory” democracy or “representative” government.

And understand this: the nuclear missiles in North Dakota are the hellish, genocidal, hyper-violent weapons of last resort that prop up this systemic “corporate-government” criminal corruption. Liberty, freedom, peace and “justice for all” have nothing to do with it. On the contrary.

A wise man said long ago: “let those who have eyes to see, see!” Can you see how deeply criminal the USA’s corporate government is? The plain meaning of the ongoing catastrophe in the Gulf of Mexico is a serious case in point.

So it is that as this oppressive system of military, political and corporate criminality crushes the Earth and her peoples under its ignorant yoke, I enter the scene as a latter-day Paul Revere, warning not that “the British are coming!” but rather “British Petroleum has come!,”and that we must “revere” the Earth much more than we have to date.

Just as BP’s actions have destroyed the Gulf of Mexico’s ecological soundness and integrity, so too has the U.S. government’s multi-trillion dollar mugging of the American people’s prosperity and posterity destroyed its integrity and claim to legitimacy. Wall Street, the Fortune 500, the Federal Reserve, and USA corp-gov puppets of the “Powers that Be” who lurk in our world’s shadows are carrying out the biggest criminal shakedown in recorded history.

The recent, so-called bail out and stimulus bills should really be called the National Mugging and National Shakedown Acts. They are funneling trillions of dollars from the people’s purses and pockets to accounts and financial institutions controlled by the wealthiest families and individuals on the planet. This is point blank robbery: the banks are robbing the people.

I say again: the nuclear missiles are the ultimate genocidal enforcer of this criminal economic arrangement, which is based on a global system of lifelong debt peonage designed to ensnare all humanity in economic bondage.

I cannot remain silent. I am here to say that I object. I cannot go along with this hideous agenda of national and global economic enslavement, which simultaneously dangles a nuclear sword of Damocles over our collective heads.

Why do we go about our business as if this state of affairs is acceptable? It’s not acceptable to me, and so I have acted, and am speaking publicly as part of the international, intergenerational, decentralized, leaderless, creatively nonviolent White Rose movement, the global direction of which lies in the eternal desire of the human heart to be free of tyranny and to be at peace.

For the White Rose, both the means and the end are the same: nonviolence. This planet has been plagued by an epidemic of warfare for millennia. But it is a logical absurdity to imagine that warfare can abolish warfare. Nonviolence offers the only sure path to a peaceful world, and this is the trajectory of the White Rose.

So how does it all play out? What’s the basic game plan? Quite simple! And the really good part is that in the end we get both our lives and our planet back from the ignorant oppressive clutches of the Powers that Be and their greedy, power mad puppets in the USA’s “corp-gov,” Wall Street, Fortune 500 and the Pentagon.

As it happens, we and the Earth are now entering into a so-called event horizon of near simultaneous, cascading ecological crises, major weather and climate change, geological and seismic disturbances, military and political upheaval, economic chaos, social unrest, agricultural problems, pollution overload and industrial emergencies.

As if on cue, BP’s Deep Water Horizon Oil Rig explosion and ongoing catastrophe in the Gulf of Mexico is ushering in the opening phase of this onrushing event horizon that will crash over us in the coming months and years.

As it happens, the Powers that Be and their puppets do not know what to do about these many crises they have played such an influential role in creating and/or worsening; even worse, they don’t really care.

It therefore falls to us, We the People, to help ourselves by unilaterally: a) declaring a Jubilee Year for sweeping forgiveness of all odious and onerous debts, and b) nonviolently and peacefully withdrawing all support for the war machinations of this planet’s governments, military organizations, corporations, and financial institutions.

What does this mean pragmatically? At a minimum it means basic measures such as:

– Pull your money out of the big banks.

– Pull your money out of the criminal casino known as the stock market, also known as Wall Street.

– Don’t pay odious and onerous debts. The USA corp-gov and major financial institutions have criminally rigged the so-called economy.

– Reduce your consumption of goods and services from Fortune 500 companies.

– Simplify your material lifestyle.

– Do not participate in industrialized slaughter of your fellow humans. In other words, refuse to go to war for the corporate mercenary force known as the Pentagon.

– Boycott corporate propaganda and news services such as ABC, CBS, Fox, CNN, MSNBC, the Wall Street Journal, Washington Post, New York Times, etc.

– Patronize, or establish your own, alternative news sources or networks.

– As many as are able, engage in creative, nonviolent acts of civil disobedience at corporate, governmental, and military installations and headquarters.

– Remember, the goal is nonviolent reform, so act nonviolently even when provoked.

– Think outside the box, with the emphasis on creative nonviolence.

In short, we are free when we stop acting like corporate-government slaves and conscripts and start behaving like sovereign, free human beings.

No one can give you your freedom. You can only claim freedom for yourself. It comes down to this: either you are free or you are not. It’s your decision. Which will it be?

Either we get rid of the nuclear missiles or they will get rid of us. We must have global, nuclear disarmament. I have on three occasions in my life gone over the fence at nuclear missile silos to perform nonviolent acts of civil disobedience.

I have been arrested and jailed, but nothing worth having comes without personal effort and sacrifice. Do you want nuclear disarmament? Do you really want to live on a planet free of the threat of nuclear apocalypse?

If you are serious, then you will have to do something. You. Personally. A wise and serious man once said: much is required of those to whom much is given.

The nuclear missiles can never be fired if the air is to remain habitable in any significantly human or humane sense. Five trillion dollars have been lavished on the USA’s planet killing, planet-impoverishing nuclear arsenal.

Trillions more dollars are being looted from the American people as you read these words.

So let the Jubilee Year began with all due alacrity. The people to whom this duty falls by rights, by which I mean the obligation to announce the Jubilee Year, have completely abdicated their responsibilities and have instead fallen in with the very worst sort of criminal element. And so the responsibility to declare a Jubilee Year necessarily passes by default to other hands. It is left to the ordinary people of the world, you and me, to announce the Jubilee, of release from onerous and odious debt, release from economic bondage.

And make no mistake. I reiterate that this has everything in the world to do with the nuclear missiles that menace the human race and the planet. The trillions of dollars spent on nuclear weaponry represent theft by taking from the people’s prosperity, the more so, as these weapons can never be used, so hideously and hellishly destructive would a nuclear war be.

Under these conditions it is both fitting and proper for the people to employ creatively nonviolent means to withdraw their support from a corrupt system that is dragging them down to collective ruin.

I am Richard Sauder and I endorse this serious message, straight from the Heart of America, in the dog days of summer 2010.

April 18, 2010. Dr. Richard Sauder, author of several books on secret underground bases, was arrested for peacefully protesting at a Minuteman III nuclear missile launch site near Parshall, Minot Air Force Base.

These truths are self-evident:

Both major political parties in the USA are massively criminally corrupt; they are essentially political mafias, tools of the Fortune 500, Wall Street, the U.S. Federal Reserve and other nefarious interests.

The present government of the USA is so mobbed up, that 50% of the American people still cannot believe and do not understand, that the murderous attacks of 9-11 were an inside job by an incredibly Machiavellian, parasitic element that has insinuated itself deep into the guts of the American system, and that lurks there malevolently, devouring its host from the inside out.

But even that 50% remnant of “true believers” in the official propaganda will have their reflexive faith sorely tested as the events of the next year unfold. (see below for links on 9/11).

I am a strong proponent of good, honest, ethical government. I feel deeply that the government should adhere to its own rule book – the Constitution. However, the present USA government is so deeply riven with corruption that I cannot help but speak out.

That is one of the reasons that I have come here.

And that is why I have left a copy of the United States Constitution at this nuclear missile silo. All officers of the USA government swear to uphold and defend the Constitution. My important public service here today consists in calling attention to that simple fact.

Richard Sauder Trial Date "Delayed Until At Least Late July."

I recently received another letter from Richard Sauder. Although his trial date had originally been set for May 21, 2010, he has informed me that it "has been delayed until at least late July." Until then he will remain in jail in Rugby, North Dakota. When the trial does occur, it is expected to be in Federal Court in Minot, North Dakota.

It is difficult communicating with Richard. The jail does not accept outside phone calls to inmates, and of course email is out of the question. It is basically a matter of old-fashioned snail mail. When I receive new information from him, however, I will pass it on.

I would encourage Richard's supporters to write to him at the above address. He will appreciate hearing from friendly voices.


Nuclear protester outlines own defense

RUGBY With little more than a week to go before the man accused of trespassing on a Minuteman III missile site near Parshall goes on trial, James Richard Sauder is outlining his own defense and speaking out against the United States government and its use of nuclear weapons.

Sauder, of Texas, was arrested after allegedly scaling the fence of H-8 missile silo on April 15 to protest against nuclear weapons by holding an American Indian-inspired prayer service on the site. He is currently being held at the Heart of America Correctional and Treatment Center in Rugby before his May 21 trial, where he faces federal criminal trespass charges. If found guilty, Sauder could face up to six months in jail, a $5,000 fine and restitution.

In a series of letters sent to The Minot Daily News, and multiple materials published on various websites, Sauder outlined his defense and his views on the federal government and nuclear weapons. Neither the prosecutor, Rick Volk of the U.S. Attorney's Office, nor Sauder's appointed attorney, Orell Schmitz, returned several phone calls and e-mails seeking comment.

Sauder is basing his defense on the Sixth Amendment, which addresses the accused's right to a speedy trial and the confrontation of witnesses in the state and district where the crime was reported to have been committed.

Using the Sixth Amendment, Sauder demanded a trial by jury and, because the H-8 missile silo resides in the Fort Berthold Indian Reservation, he demanded that the jury be drawn from the Three Affiliated Tribes Nation.

In a letter dated April 22, Sauder said: "The questions of war and peace, and massive government criminality are too important to be left to the sole discretion of a lone Federal Magistrate," it said. "That is why the Sixth Amendment exists. The people are entitled and obligated to render their opinions and judgments."

After he was denied a jury trial by Judge Magistrate Charles Miller Jr. at a hearing in April, Sauder wrote in an April 30 letter, "The U.S. government and military are rife with massive criminal corruption. Federal judges swear to uphold the U.S. Constitution and yet Charles Miller has already thumbed his nose at the U.S. Constitution by denying me a right enshrined in the Sixth Amendment. I am effectively a political prisoner at this point."

Citing Lewis V. United States, a 1995 U.S. Second Circuit Court of Appeals court case which addressed the right of defendants to a jury trial, Sauder is not entitled to a jury trial, said Alex Reichert of Reichert and Armstrong Law Office, who has taken cases involving tribal affairs to the U.S. Supreme Court but is not involved in the case.

"He's being charged with a petty crime and since he faces six months or less, he doesn't get a jury trial," he said, adding that cases demanding jury trials for various offenses using the Sixth Amendment are not uncommon.

In fact, the North Dakota Supreme Court issued an opinion Tuesday on Riemers v. Grand Forks Municipal Court, granting Roland Riemers, who is running for Sheriff of Grand Forks County, the right to a trial by jury for a noncriminal municipal traffic citation punishable by a $20 fine.

Beyond his fight to have a jury trial, Sauder is also questioning the jurisdiction of the court.

Although the incident occurred on an Air Force military installation, Sauder argues that because the silo resides on tribal lands, he should be under tribal jurisdiction.

Citing Oliphant V. Squamish, a 1978 U.S. Supreme Court decision regarding criminal jurisdiction of tribal courts over non-natives, B.J. Jones, director of Northern Plains Indian Law Center at the University of North Dakota, said because Sauder is not an American Indian, he can not be tried by the tribe.

"The Supreme Court ruled that non-natives can not be prosecuted in criminal cases by the tribe," said Jones, who is not involved in the case. "Because he's not native, he can not be tried under tribal jurisdiction."

Before Sauder came to North Dakota in April to protest nuclear weapons, he released his "Minot Manifesto" online. In a diatribe, Sauder denounces the U.S. government as a corrupt "global mafia" that is assaulting and undermining the U.S. Constitution and the Bill of Rights, and uses nuclear weapons to impose its will on other countries.

"Nuclear weapons are the ultimate, genocidal guarantors of the MATRIX control structure that The Powers That Be have established on this planet. Nuclear missiles represent the ultimate threat by The Powers That Be to wage apocalyptic warfare on the peoples of the world. They must be seen in their proper hyper-violent context: the willingness of The Powers That Be to do anything, anything at all, up to and potentially including killing hundreds of millions of people at a time, to maintain their nefarious control over this planet and its human population," it said. "The silence over the horrors of nuclear weaponry is a terrible silence that is purchased with huge amounts of hush money by powerful military, industrial, political and financial interests in the USA and elsewhere."

 

 
 

Man accused of silo trespass pleads not guilty
Trial date set

The man charged with trespassing on an Air Force missile launch site near Parshall last week has pleaded not guilty and will go to trial.

James Richard Sauder of San Antonio, Texas, pleaded not guilty to the charge of federal criminal trespass at a detention hearing Monday. The trial date has been set for 10 a.m. Friday, May 21, at the U.S. District Courthouse in Minot. He waived his rights at the hearing and will remain in custody until the trial. Sauder's attorney, Orell Schmitz, would not comment on the case citing insufficient information.

Sauder has been charged with federal criminal trespass for allegedly climbing the security fence of the H-8 missile silo on April 15 to protest against the use of nuclear weapons. The charge carries the possibility of 6 months in jail, a $5,000 fine and restitution.

Man arrested at silo to face federal charges

The man arrested Thursday at a Minuteman III launch site near Parshall will face federal charges.

James Richard Sauder, 55, of San Antonio, Texas, was arrested after allegedly scaling the fence of the H-8 missile silo southwest of Parshall to conduct a peaceful protest against nuclear weapons. He was initially charged with criminal trespass, a Class C felony, and spent the night in the Mountrail County jail in Stanley.

Special Agent E.K. Wilson of the FBI said Sauder has been charged with one count of federal criminal trespass and was taken into federal custody Friday afternoon. Wilson said a criminal complaint filed Friday morning was pending, but would not speculate on any additional charges.

Dressed in a green plaid, button-up shirt and khakis, under which ankle shackles could be seen, Sauder made his initial court appearance Friday afternoon at the U.S. District Courthouse in Minot in front of Magistrate Judge Charles S. Miller Jr. via videoconference.

Throughout the 45-minute hearing, Sauder repeatedly interrupted Miller by raising issues of jurisdiction, intent and his right to trial by jury, all of which were rebuffed until the appropriate hearing.

Sauder was appointed a public defender and was placed in the custody of the Attorney General until a detention hearing is held on Monday. He'll remain in custody until then in the Ward County Jail. No trial date has been set.

This is not Sauder's first run in with the law, said Attorney Francis A. Boyle.

Boyle said he represented Sauder in 1982 when Sauder performed a similar demonstration at a missile launch facility at Whiteman Air Force Base in Missouri. Sauder was charged with federal criminal trespass, found guilty and served six months in prison, he added.

Minus the occasional letter, Boyle said he had not spoken to Sauder for nearly three decades before receiving a phone call Thursday asking him to represent Sauder.

"People like Richard and the Ploughshares and others are some of the most principled people I've ever been fortunate enough to meet and I believe they have a right to peaceful, non-violent, prayerful demonstration against weapons of massive destruction and genocide," Boyle said. "The future of humanity is at stake here and Richard and those like Richard out there are trying to do something."

A law professor at the University of Illinois, Boyle is a scholar in the areas of international law and human rights. An author, Boyle's Protesting Power: War, Resistance and Law (Rowman & Littlefield Inc. 2007) has been used successfully in anti-war protest trials, according to the school's Web site.

Boyle said he has represented numerous similar cases involving peaceful protests against nuclear weapons.

"It was a very thoughtful, prayerful act at an Indian reservation, I do that myself at church. I don't understand why praying on a silo is a threat to anyone it's simply mindboggling" Boyle said. "It's criminal what those missiles represent. Praying is the most effective tool we have right now to fight these Nazi-type weapons of genocide."

PARSHALL Air Force security personnel, Mountrail County Sheriff's Department, Three Affiliated Tribes police and the FBI are investigating an incident Thursday in which a man jumped the fence of a Minuteman III launch site near Parshall.

According to the Minot Air Force Base Public Affairs office, 91st Missile Wing security forces personnel responded to an activated alarm at H-8 missile silo, located south of Parshall, and detained a man identified by the Mountrail County Sheriff's Department as James Richard Sauder of San Antonio. The suspect was later handed over to the sheriff's department who transferred him to the Mountrail County Jail in Stanley.

Special Agent E.K. Wilson, of the FBI branch in Minneapolis, said several FBI agents were on the scene Thursday afternoon working with the Air Force and local police to assess the situation and security threat, but could not comment further.

"The federal investigation is ongoing and we are working closely with the U.S. Attorney's Office, but it appears to be no nexus of terrorism," said Supervisory Special Agent Paul McCabe. "He has been charged on local charges, but the decision of whether to charge him federally is still pending."

Sauder was charged with criminal trespass, a Class C felony, according to Sheriff Ken Halvorson.

"The FBI is the lead investigative agency on the case, but from the initial information we have gathered we believe he was acting alone," said Laurie Arellano, chief of Public Affairs at Minot AFB. "There's no history or anything that would tie him here so it appears it was a random selection."

No motive has been established.

Steve he declined to give his last name watched the event unfold Thursday morning from his home near the H-8 missile silo, located near the intersection of 76th Avenue and 33rd Street Northwest.

"Early this morning, before 8 a.m., I saw this little red van parked in front of the gate, but I didn't see anyone around. I left and came back at about 9 (a.m.) and saw two helicopters flying low level and Air Force and police flying up and down the road blocking things off," he said. "I've lived here my whole life and I've never seen anything like it before. There was a lot of lights and moving around, but the airmen were calm and looked very professional, very well trained."

The van, a red 1993 Plymouth Voyager, was inspected by the Minot AFB Explosive Ordnance Disposal and the Minot Police Department Bomb Squad, but no explosives were detected. The van was then towed to the Minot Police Department for further investigation.
